Terms and Conditions of Usage

These Terms and Conditions of Usage (hereinafter referred to as the “Terms”) govern your use of the content and services available on the Vybein digital platform, accessible via www.vybein.com or the VYBEIN mobile application.
(Hereinafter referred to as “VYBEIN”, “we”, “us”, “our”, “Application”, or “VYBEIN Application”).

1. Updates (Updation)

VYBEIN reserves the right to update, modify, or change these Terms from time to time without prior notice. It is the responsibility of the user to review these Terms periodically to ensure compliance with the latest rules. Updated Terms published on the Application shall be deemed effective immediately upon posting.

2. User Consent

  • You have carefully read these Terms;
  • You fully, clearly, and voluntarily accept them without any coercion;
  • If you do not agree with these Terms, please do not use the Application and do not click “I AGREE”.
  • Continued use of the Application indicates your legal agreement to be bound by these Terms.

3. Geographical Scope (India Only Operation)

VYBEIN is a digital platform that operates exclusively within India. All services, servers, data processing, and operations are conducted only within India. VYBEIN does not, in any foreign country: Provide any services; Appoint any experts or service providers; Offer any cross-border digital services. Even if the Application is accessed from outside India, the user acknowledges that all legal jurisdictions will apply exclusively within India; for any dispute or legal action, Indian law and Indian courts shall have the final authority.

4. General Description

  • Digital content, reports, data, in-app communication, information-based services (collectively referred to as “Content”)
  • Free and paid services (collectively referred to as “Services”)

Some services may be available without registration. Registration is mandatory for access to special features, content, or paid services.

5. Registration and Eligibility

  • You are 18 years of age or older;
  • You are capable of entering into a valid contract under the Indian Contract Act, 1872;
  • VYBEIN shall not be responsible for misuse by a minor.

6. Account Creation & Security

  • Users can create an account using mobile number and OTP, email, or other valid login methods.
  • All information provided must be true and up-to-date; users will not use anyone else’s account.
  • VYBEIN reserves the right to suspend or terminate accounts if false or misleading information is found.
  • Accounts are strictly for personal use; users are responsible for securing passwords and login credentials; all activities under the account are the user’s responsibility; users must immediately notify VYBEIN of any unauthorized use.

7. Role and Limitations of the Platform

  • VYBEIN acts solely as a digital intermediary platform; it does not guarantee any results, success, or user experience; VYBEIN has no control over third-party content or services; users understand and accept the inherent data risks associated with internet-based services.

8. Zero Tolerance Policy

Prohibited Conduct:

  • Abuse and Harassment: Use of abusive, threatening, or offensive language; obscene, indecent, or objectionable messages; mental, emotional, or digital harassment.
  • Illegal or Objectionable Content: Obscene/pornographic content; content promoting hatred or discrimination; promotion of violence, crime, drugs, or illegal activities; false or misleading information.
  • Fraud and Misrepresentation: Misuse of fake profiles or identities; economic or digital fraud.
  • Platform Misuse: Hacking, tampering with technical systems, or security breaches; unauthorized data access or misuse; deliberate violation of rules and policies.
  • Violations Related to Minors: Any improper or objectionable behavior with persons under 18 years of age; breach of rules relating to the safety of minors.

9. Complaints, Penalties & Actions on Violations

  • VYBEIN reserves the right to investigate complaints, impose penalties, suspend or terminate accounts, restrict future use, take legal action, and share information with law enforcement agencies if necessary.
  • Users shall not have any claim, compensation, or right to damages for any action taken by VYBEIN under these provisions.

VYBEIN Call / Chat Feature (User Interaction Feature)

  • VYBEIN is a social interaction and interest-based meet-up application that provides users with digital tools to connect via in-app calls and in-app chats based on shared interests.
  • VYBEIN does not share any user’s mobile number, email, or address with other users. All calls and chats are available only within the application (in-app). VYBEIN does not permit direct calls to a user’s mobile number.
  • VYBEIN is not a dating, matrimonial, medical, healthcare, counseling, or therapy platform. VYBEIN does not organize any meet-ups, events, or activities itself. The Application solely facilitates user-to-user social interaction. Every conversation, meet-up, or interaction between users is completely voluntary, and VYBEIN is not responsible for any such interaction.

Application Content

  • The Application, its design, software, text, graphics, logos, features, and external links are the private property of VYBEIN. Users agree not to post or share any content on the Application that is illegal, offensive, obscene, or abusive; violates someone’s privacy, dignity, or rights; promotes violence, harassment, fraud, or illegal activity. In case of any such activity, VYBEIN reserves the right to suspend or permanently terminate the user’s access.

Disclaimer

  • VYBEIN is not responsible for any information, opinions, behavior, or decisions shared by users. Any of the following conducted through the Application: in-app calls, in-app chats, meet-ups, offline interactions are entirely at the user’s own responsibility and risk. VYBEIN does not guarantee security, behavior, outcomes, or user experience.

Limitation of Liability

  • If any dispute, loss, or damage arises due to the actions or negligence of another user, only the respective user will be liable. Users agree that they will not hold VYBEIN legally responsible or file any claims against VYBEIN for such matters.

User Account Access

  • VYBEIN has access only to your in-app account and the information entered therein. Such access is strictly limited to maintaining the quality of the Application’s services, resolving user complaints or requests, and investigating suspicious activities or misuse. VYBEIN does not share any data or information with unauthorized parties or make external calls/contacts.

Data Processing

  • All VYBEIN services and technical operations are conducted exclusively from India. Limited user data may be processed only within India, with the user’s consent and in compliance with applicable data protection laws.

Privacy Policy

  • The user acknowledges that they have read and fully understood VYBEIN’s Privacy Policy. Any amendments or updates made from time to time will also be binding on the user.

Breach and Termination

  • VYBEIN reserves the right, without prior notice, to partially or fully modify, suspend, or discontinue any service; suspend or terminate a user’s account. If a user violates these Terms, their registration may be immediately canceled. VYBEIN may terminate an account under the following circumstances: the provided information is not authentic or cannot be verified; activities pose legal risks to VYBEIN or other users; false, misleading, or deceptive information is provided; obstructing platform operations, disturbing other users, or violating the Privacy Policy.

Status of Service Provider / Organizer (If Applicable)

  • If a user is registered as a meet-up host, organizer, or service provider: their relationship with VYBEIN is solely as an independent member; they are fully responsible for their actions and decisions; VYBEIN reserves the right to suspend or deactivate such users’ profiles in case of violation of Terms or Service Conditions.

Account, Wallet, Refund, Cashback, Reward & Payment Policy

  • After account signup, the user will create their login password. If the user uninstalls the app, they must use the registered mobile number and password to log in again. A forgot password option will be available, allowing the user to reset the password via OTP verification on the registered mobile number. The user cannot directly logout; they can only submit a logout request. After submitting a logout request, for security reasons, the user account will be automatically logged out after 30 days.
  • Refund Policy: If a match request is not accepted or there is no response after a match is created, the full payment amount will be credited to the wallet available balance. In such cases, any used reward amount will also be credited back to the reward balance. If a match request is accepted and a user cancels the meetup/match, no refund will be provided. For a solo match, if the meetup does not happen due to the other user, only the top-up amount will be returned to the wallet available balance; reward balance will not be refunded.
  • Cashback & Reward Policy: For a successfully completed match, 10% of the total payment amount will be instantly credited to the user’s reward balance. At the time of creating or finding a match, 5% of the total payment will automatically be deducted from the wallet reward balance. The remaining amount will be deducted from the wallet available balance (top-up).
  • Referral Policy: If a user shares the app and a new user uses the referral code, the referring user will receive ₹10 credited to the wallet available balance. The new user using the referral code will receive ₹5 credited to the wallet available balance. Both amounts will automatically be available in the wallet top-up (available balance).
  • Temporary Hold / Pause: Under special circumstances, VYBEIN reserves the right to temporarily hold or pause the wallet, reward, cashback, or referral system. VYBEIN may make adjustments in accordance with system security and platform policy.
  • Wallet Balance Display: Available balance (₹), reward balance (₹). Both balances will display the ₹ currency symbol, but their usage and deduction rules differ. All wallet usage, balances, top-up/available balance, and reward balance transaction details will be available in the in-app wallet history.
  • Wallet Top-Up / Recharge & Reward Balance Usage: Wallet top-up / recharge and reward balance can only be used for platform fees, digital tools, and feature excess fees. They cannot be transferred, cashed out, or used externally. VYBEIN does not accept any physical cash, external transactions, or third-party payments and will not be responsible for them.

Additional Terms & Policies

  • PROHIBITED ACTIVITIES & ENFORCEMENT: Any form of fraud, abuse, harassment, obscene content, misinformation, illegal activity is strictly prohibited. VYBEIN follows a ZERO TOLERANCE POLICY and may suspend or permanently close accounts without prior notice. VYBEIN is not responsible for any consequences arising from such actions.
  • SUPPORT & COMPLAINT DISCLAIMER: VYBEIN does not provide live support or guarantee instant resolution. Users can contact for assistance or complaints via in-app support/complaint option or email: vybein.official@gmail.com. All requests will be handled as per platform policy.
  • THIRD-PARTY SERVICES: VYBEIN is not responsible for the authenticity, security, availability, or privacy practices of any third-party website, link, advertisement, or service.
  • LIMITATION OF LIABILITY: Under no circumstances shall VYBEIN be liable for direct, indirect, incidental, consequential losses or damages. VYBEIN’s maximum liability is limited to the platform/feature access fee paid by the user.
  • JURISDICTION: All disputes shall be governed by Indian law, and courts in Lucknow, Uttar Pradesh shall have exclusive jurisdiction.
  • INDEMNIFICATION: The User agrees to indemnify, defend, and hold harmless VYBEIN, its owners, directors, officers, employees, authorized representatives, technical partners, and service providers from any claims, liabilities, losses, damages, and/or costs (including attorney fees) arising from third parties. This indemnification applies to claims arising from the User’s use of the VYBEIN platform or its digital services, violation of these Terms of Service or Privacy Policy, infringement of any third-party rights, including intellectual property rights, and any claims arising from content uploaded, shared, or transmitted by the User. These Terms also apply for the benefit of VYBEIN’s successors, assigns, and authorized licensees. VYBEIN provides digital platform services only in India. VYBEIN is not responsible for any claims, liabilities, or legal consequences arising from use or activity outside India, and the User is solely responsible for such matters. This provision does not create any employment, agency, partnership, or local establishment relationship.
  • PROPRIETARY RIGHTS TO CONTENT: The User acknowledges that all content available on the VYBEIN application and platform, including text, software, code, interface, images, photographs, graphics, videos, audio, design, logos, icons, UI/UX, and information delivered via notifications, email, or in-app messages are protected by copyright, trademark, service marks, patents, and other intellectual property laws. The User may not, without prior written permission, copy, reproduce, distribute, modify, publicly display, or create derivative works. Some images, icons, or designs may be sourced from open-source, licensed, or publicly available online sources. VYBEIN does not claim independent copyright over third-party source content.
  • NOTICES: Except as otherwise specified in these Terms of Service, all notices shall be in writing and may be sent via email or regular mail. A notice will be deemed received 24 hours after sending by email or 3 days after deposit by regular mail. Addresses: Member’s address as provided in the Registration Data; VYBEIN official contact: vybein.official@gmail.com. VYBEIN is an India-based platform and does not operate any foreign or region-specific offices or emails.
  • RESTRICTED CONTENT: Child Endangerment: Any exploitative, offensive, or illegal content related to children is strictly prohibited on the VYBEIN platform. Prohibited content and activities include all forms of Child Sexual Abuse Material (CSAM), inappropriate or sexually suggestive communication targeting minors, child grooming, sexual depiction or exploitation of minors, sextortion, child trafficking or commercial sexual exploitation. If such content is detected, the account may be immediately suspended or terminated and necessary actions will be taken under applicable Indian laws. Adult and Harmful Content: The following content is also prohibited: extremely violent, bloody, or dangerous content targeting children, content promoting negative body image, self-image, or unhealthy habits, misleading, exploitative, or mentally harmful content. VYBEIN is committed to maintaining a safe digital social platform.
  • USER OBLIGATION: The User — including Members and users providing content or interactions — is fully responsible for complying with VYBEIN’s Privacy Policy, adhering to Terms & Conditions, and following all rules and guidelines posted on the application from time to time. The User certifies that they are an individual person, are not a company, partnership, firm, LLP, or any other legal business entity, and will use the services of the application only for personal purposes, and will not transfer, share, or resell them to any other person, group, or organization.
  • USER RESTRICTIONS: The User shall not post, publish, upload, or transmit any message, content, data, or information that is false, misleading, defamatory, offensive, threatening, harassing, or disturbing, violates the privacy, dignity, or personal rights of any individual, promotes racial, religious, ethnic, gender-based, or any form of hatred, infringes the intellectual property rights (IP), copyright, trademark, or other legal rights of others, violates any applicable law, regulation, or judicial order, or may result in civil/criminal liability. The User shall not upload or share any content for which they do not have a valid legal right or permission, that infringes any patent, trademark, trade secret, copyright, or other property rights. However, the User may use limited excerpts under the Fair Use principle, provided it is legally permitted.
  • TECHNICAL AND BEHAVIORAL RESTRICTIONS: The User agrees that they will not collect other members’ screen names, emails, phone numbers, or other information for advertising, promotion, or spam purposes, send unsolicited emails, SMS, junk mail, spam, chain letters, or promotional messages, upload or distribute viruses, malware, corrupted files, or any harmful software, participate in any activity that disrupts the application functionality, servers, network, or access, attempt unauthorized access, including hacking, password mining, data scraping, illegal access to systems or networks. Under no circumstances shall the User resell the services or use them for commercial, agency, or brokerage purposes unless expressly permitted in writing by VYBEIN.
  • SOFTWARE AND PLATFORM SECURITY: The User agrees not to reverse engineer, decompile, modify, or copy the application or any part of it, use, distribute, or license any software, data, or feature without authorization, attempt to create or sell derivative works.
  • COMMUNICATION AND CONDUCT: Upon registering as a member, the User agrees that they may receive communications from the application via email, SMS, RCS, or WhatsApp Business Messages, will not share any illegal, threatening, obscene, or offensive content, will not use content that may result in criminal or civil liability, will not interfere with the experience, security, or usage of other users, and will report any misuse, technical issue, or rule violation immediately to VYBEIN.
  • ENFORCEMENT: Membership of Users making false, malicious, or baseless claims may be terminated without refund. Services of Users engaging in highly inappropriate, offensive, or rule-violating behavior may be temporarily or permanently suspended. Repeated violations may result in a permanent ban. Any Wallet balance, if available, may be returned after deducting applicable fees.
  • GCC USERS (IF ANY): Users in GCC countries or outside India are responsible for complying with their local laws, cyber regulations, and digital rules. Since VYBEIN services are provided digitally from India, VYBEIN is not responsible for any local legal consequences.
  • DANGEROUS PRODUCTS: Explosives and Firearms: Users shall not facilitate the sale, promotion, or transaction of any of the following via the VYBEIN platform: explosives, firearms, ammunition, restricted or controlled weapons, firearm parts or accessories. Users shall not post, share, or transmit content that provides instructions to make explosives, weapons, or ammunition, provides information to convert a firearm into automatic or simulated automatic firing, promotes any violent or illegal activity. If such activities are detected, VYBEIN reserves the right to suspend/terminate the account without prior notice and notify law enforcement agencies. Psychotropic / Influential Drugs: Users shall not sell, promote, or facilitate marijuana, cannabis, or any related products (regardless of legal status), tobacco products (cigarettes, e-cigarettes, vape pens, etc.), alcohol, narcotics, or content promoting illegal, inappropriate, or harmful use of tobacco or drugs, psychotropic drugs, drugs restricted under the Drugs & Cosmetics Act, 1945 or any other applicable law. VYBEIN does not support or facilitate any such activities.
  • VYBEIN SERVICES: Scope of Services: These Terms of Service apply to all users of the VYBEIN digital platform. Content or information shared by users on the platform may include third-party apps, websites, links or services. These are not owned, controlled, or operated by VYBEIN. Third-Party Responsibility: VYBEIN does not control any third-party content, privacy policies, services, or actions, is not responsible for any errors, misinterpretation of law, defamation, omissions, or false, offensive, or obscene content shared by third parties or other users. Editing and Censorship: VYBEIN is not obligated to censor, edit, or control content of any user or third-party website/application. Acknowledgement: By using VYBEIN services, the user expressly acknowledges that VYBEIN is not responsible for any loss, claim, or liability arising from any content, third-party apps/links, or external services. The user also understands and agrees that opinions, statements, or information in any content available on the platform reflect only the personal views of the respective author/user. Such content should not be considered as endorsed, confirmed, or approved by VYBEIN.
  • GOVERNING LAW & JURISDICTION: Dispute Resolution (Arbitration): Any dispute, claim, or difference arising out of these Terms of Usage or the use of the VYBEIN app/services shall be resolved in India through a Sole Arbitrator, mutually appointed by the user and VYBEIN. The arbitration will be conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996. Place of Arbitration: Lucknow, Uttar Pradesh, India. Language of Arbitration: English. The decision of the arbitrator shall be final and binding. Interim Relief: Until the completion of the arbitration process, either party shall have the right to seek interim relief from the competent courts in Lucknow, Uttar Pradesh, India to protect its rights. Both parties agree to the jurisdiction of the courts in India, and specifically the courts of Lucknow, Uttar Pradesh. If any party acts contrary to this provision, the other party shall be entitled to recover attorney fees and costs up to ₹1,50,000 (One Lakh Fifty Thousand Rupees). Interpretation of Law: These Terms of Usage shall be governed by and construed in accordance with Indian laws. If any provision is found to be invalid or unenforceable, it shall be modified/interpreted to the fullest extent possible to give it legal effect, and all remaining provisions shall remain fully effective.
